Rent review success

Crickmay were appointed by a national retailer to advise on a rent review in Plumstead, London, SE18.  When a settlement could not be agreed with the Landlord’s Surveyor, the Tenant Client instructed our surveyor Andrew Hall to make a third party application to the RICS for the appointment of an Arbitrator to act as a third party resolver.  Following Andrew’s Representation and a Reply to the submission of his opposite number, the Arbitrator subsequently awarded that in his opinion the rent at the review date was less than that currently being paid.  Due to the service of a Calderbank offer this meant the issue of costs was brought into question.  After further representations, the Arbitrator awarded that the Landlord should pay all of his own fees, the Tenant’s costs to include those of Crickmay, which the Client had incurred, post the Calderbank offer. 

The national retailer was obviously delighted with the outcome, together with the service and experience Andrew brought to proceedings.
